Welcome to Sail To Komodo.

Please read these Terms & Conditions carefully before making a booking. By accessing our website, submitting a reservation, making a payment, or participating in any tour, cruise, charter, liveaboard, or activity operated by Sail To Komodo, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms & Conditions.

These Terms & Conditions form a legally binding agreement between Sail To Komodo and all guests, travelers, customers, agents, and representatives making bookings through sailtokomodo.com or any of our official sales channels.

Booking Policy

All bookings are subject to availability and are not guaranteed until confirmed in writing by Sail To Komodo.

A reservation shall only be considered confirmed when:

• Required guest information has been received.
• The required deposit or full payment has been successfully received.
• A written confirmation has been issued by Sail To Komodo.

Availability shown on the website, social media platforms, messaging applications, or other promotional materials does not guarantee availability until a booking has been officially confirmed.

Sail To Komodo reserves the right to refuse, decline, or cancel any booking request at its sole discretion.

Guests are responsible for ensuring that all information provided during the booking process is accurate, complete, and up to date. Any errors in names, contact information, travel details, or personal information may result in additional costs, delays, or cancellation of services, for which Sail To Komodo accepts no responsibility.

Payment Terms

To secure a reservation, a deposit may be required at the time of booking. The required deposit amount will be specified in the booking confirmation or invoice.

Unless otherwise stated:

• Deposits are non-refundable.
• Deposits are non-transferable.
• Deposits cannot be exchanged for cash or applied to unrelated bookings.

The remaining balance must be paid by the due date specified in the booking confirmation. Failure to complete payment by the stated deadline may result in automatic cancellation of the booking without prior notice. In such cases, any deposit already paid shall be forfeited.

Guests are responsible for all transfer fees, banking fees, currency conversion charges, payment gateway fees, and any other transaction-related costs.

Sail To Komodo reserves the right to adjust prices before booking confirmation due to currency fluctuations, supplier price changes, fuel surcharges, government fees, taxes, or operational requirements.

Cancellation Policy

Cancellation by Guest

All cancellation requests must be submitted in writing. The effective cancellation date shall be the date on which Sail To Komodo receives the written cancellation request.

Unless otherwise specified in writing:

• Deposits are strictly non-refundable.
• Deposits are strictly non-transferable.
• Administrative fees are non-refundable.
• Government fees and permit fees may be non-refundable.

For cancellations made closer to the departure date, cancellation charges of up to 100% of the total booking value may apply.

No refund shall be provided for unused services, missed activities, voluntary withdrawal from the trip, early departure, personal scheduling conflicts, illness, visa issues, transportation delays, or any circumstance beyond Sail To Komodo's control.

No Show Policy

Guests who fail to arrive at the designated meeting point, harbor, airport transfer point, hotel pickup location, vessel departure point, or activity location at the specified time shall be considered a "No Show."

No Shows are not eligible for:

• Refunds.
• Travel credits.
• Rescheduling.
• Compensation.

The entire booking value shall be forfeited. Guests are strongly advised to arrive in Labuan Bajo at least one day before departure to minimize the risk of missing their trip due to airline delays or cancellations.

Flight Delays and Missed Connections

Sail To Komodo is not responsible for:

• Delayed flights.
• Cancelled flights.
• Rescheduled flights.
• Missed flight connections.
• Airport disruptions.
• Airline operational issues.

Any expenses arising from flight disruptions remain the sole responsibility of the guest. Guests are strongly encouraged to purchase comprehensive travel insurance that covers trip interruption and travel delays.

Rescheduling Policy

Requests to change travel dates are subject to availability and approval. Approval of a rescheduling request is not guaranteed.

Where approved, the following may apply:

• Administrative fees.
• Seasonal rate adjustments.
• Supplier penalties.
• Additional operational costs.
• Fare differences.

Sail To Komodo reserves the right to reject any rescheduling request.

Weather Conditions and Sea Safety

The safety of guests, crew members, vessels, and operations is our highest priority. Komodo National Park and surrounding waters are subject to changing weather conditions, ocean currents, tides, wind conditions, and government maritime regulations.

Guests acknowledge and accept that:

• Weather conditions may change unexpectedly.
• Sea conditions may become unsafe.
• Port authorities may prohibit departures.
• Destinations may become inaccessible.

For safety reasons, Sail To Komodo reserves the absolute right to: modify itineraries, change routes, replace destinations, delay departures, return early, cancel activities, or cancel departures.

Such decisions are made solely in the interest of safety and shall not constitute grounds for compensation, damages, or full refunds.

Itinerary Changes

All itineraries published on the website, brochures, social media platforms, and promotional materials are intended as guides only.

Destinations, schedules, routes, activities, and timings may be changed at any time due to: weather conditions, sea conditions, government regulations, national park regulations, vessel operations, safety considerations, or local authority instructions.

No refund or compensation shall be provided solely because a particular destination, activity, viewpoint, beach, island, or attraction becomes unavailable.

Komodo National Park Regulations

Guests agree to comply with all regulations established by:

• Komodo National Park Authority.
• Local government authorities.
• Harbor authorities.
• Maritime authorities.
• Conservation agencies.

National park fees, ranger fees, conservation fees, entrance fees, and government charges may change without prior notice. Closures, restrictions, route changes, or access limitations imposed by government authorities shall not constitute grounds for cancellation or refund claims against Sail To Komodo.

Health, Fitness, and Medical Conditions

Guests are responsible for ensuring they are physically and medically fit to participate in the booked activities.

Guests must disclose any condition that may affect their ability to travel safely, including but not limited to:

• Heart conditions.
• Respiratory disorders.
• Severe allergies.
• Epilepsy.
• Pregnancy.
• Mobility limitations.
• Recent surgeries.
• Chronic medical conditions.

Failure to disclose relevant medical information may result in denial of participation without refund. Sail To Komodo reserves the right to refuse participation where guest safety may be compromised.

Snorkeling, Trekking, Diving, and Activity Risks

Guests acknowledge that adventure travel and marine activities involve inherent risks. Such risks may include:

• Strong currents.
• Slippery terrain.
• Falls.
• Wildlife encounters.
• Marine hazards.
• Equipment malfunction.
• Injury, Illness, or Drowning.
• Emergency evacuation.

Participation in any activity is entirely voluntary. By participating, guests voluntarily assume all associated risks and accept full personal responsibility for their participation.

Travel Insurance

Comprehensive travel insurance is strongly recommended for all guests. Travel insurance should include coverage for: medical treatment, emergency evacuation, trip cancellation, trip interruption, personal liability, adventure activities, lost baggage, and flight delays.

Unless specifically stated otherwise, travel insurance is not included in the tour price.

Personal Belongings

Guests are solely responsible for their personal belongings at all times.

Sail To Komodo accepts no responsibility for loss, theft, damage, delay, or misplacement of: luggage, passports, cash, jewelry, cameras, drones, mobile phones, electronic equipment, or personal documents.

Guest Conduct

Guests must behave respectfully toward: fellow travelers, crew members, guides, local communities, wildlife, and the environment.

Sail To Komodo reserves the right to remove any guest whose behavior is deemed unsafe, disruptive, abusive, illegal, aggressive, intoxicated, or harmful. No refund shall be provided in such circumstances.

Photography and Marketing Consent

During tours and activities, photographs and videos may be taken by Sail To Komodo or its representatives.

Unless a guest submits a written objection prior to departure, the guest grants Sail To Komodo permission to use such images and recordings for: marketing, advertising, social media, website content, promotional materials, and commercial purposes. No compensation shall be payable for such use.

Chargebacks and Payment Disputes

Guests agree not to initiate fraudulent or unjustified chargebacks, payment reversals, or disputes for services that have been delivered in accordance with these Terms & Conditions.

Where a chargeback is initiated without valid legal basis, Sail To Komodo reserves the right to recover all associated costs, including administrative fees, banking charges, collection costs, legal expenses, and damages.

Force Majeure

Sail To Komodo shall not be liable for any delay, cancellation, modification, interruption, loss, injury, expense, or failure to perform services resulting from circumstances beyond its reasonable control.

Such events include, but are not limited to: natural disasters, earthquakes, volcanic eruptions, tsunamis, floods, fires, pandemics, epidemics, war, terrorism, civil unrest, government actions, port closures, transportation disruptions, and extreme weather.

In such circumstances, refunds may not be available, and alternative arrangements, travel credits, or rescheduling options may be offered at Sail To Komodo's sole discretion.

Limitation of Liability

To the fullest extent permitted by applicable law, Sail To Komodo shall not be liable for any indirect, incidental, consequential, special, punitive, or economic damages arising from the use of its services.

Under no circumstances shall Sail To Komodo's total liability exceed the amount actually paid by the guest for the specific booking giving rise to the claim. Guests acknowledge that participation in travel activities is undertaken at their own risk.

Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Indonesia.

Any dispute arising from these Terms & Conditions shall first be resolved through good-faith negotiation. Where resolution cannot be achieved amicably, the dispute shall be submitted exclusively to the competent courts of Indonesia.

Acceptance of Terms

By making a booking, submitting payment, participating in any activity, or using services provided by Sail To Komodo, guests acknowledge that they have read, understood, and agreed to these Terms & Conditions in their entirety.

If a guest does not agree with any part of these Terms & Conditions, they should not proceed with the booking.
